Terms of Service

These terms are the agreement between you and NEK. By using our service, you agree to them. We've tried to write them in plain language. Read them.

1. Acceptance of terms

By accessing or using NEK ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, don't use the Service.

You must be at least 16 years old to use NEK. If you're using NEK on behalf of a company, you confirm you have authority to bind that company to these Terms.

2. Your account

You're responsible for keeping your account secure:

  • Use a strong password and don't share your credentials
  • Notify us immediately if you suspect unauthorized access
  • You're responsible for all activity on your account
  • Provide accurate information — fake accounts will be terminated

One account per person. Each user on a team plan needs their own account.

3. Acceptable use

You agree not to use NEK to:

  • Violate any law or regulation
  • Infringe intellectual property rights of others
  • Upload malware, illegal content, or harassing material
  • Reverse engineer, decompile, or attempt to extract source code
  • Resell or sublicense the Service without our written permission
  • Overload our infrastructure with automated requests or scraping
  • Bypass rate limits, storage quotas, or feature restrictions

Violations may result in immediate suspension or termination.

4. Your content

You own your projects. Floor plans, designs, materials, and 3D scenes you create remain your property.

By using NEK, you grant us a limited license to host, store, and display your content for the purpose of providing the Service. This license ends when you delete the content or your account.

We do not use your projects to train AI models without your explicit consent. AI features that learn from user data are opt-in only.

You are responsible for backing up important work. We recommend exporting projects regularly to local storage.

5. Payment & subscriptions

Free plan

The Free plan is available indefinitely with the limits described on our pricing page.

Paid plans

Paid subscriptions are billed in advance, monthly or annually. By subscribing, you authorize us to charge your payment method automatically until you cancel.

Prices may change. We'll notify you at least 30 days before any price increase.

Trials

14-day free trials require a payment method but won't be charged until the trial ends. We send a reminder 3 days before the trial ends.

Failed payments

If a payment fails, we'll retry several times. If we still can't charge after 7 days, your subscription is downgraded to the Free plan.

6. Cancellation & refunds

You can cancel any time from your account settings. Cancellation takes effect at the end of your current billing period — you keep access until then.

Refund policy:

  • Monthly plans: no partial refunds for unused time
  • Annual plans: pro-rated refund within the first 30 days
  • Enterprise: refund terms specified in your contract

If we terminate your account for violation of these Terms, you are not entitled to a refund.

7. Intellectual property

NEK's software, design, branding, documentation, and Built-in libraries are owned by NEK and protected by copyright, trademark, and other laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription.

You may not:

  • Copy, modify, or create derivative works of the Software
  • Use NEK's name, logo, or branding without written permission
  • Remove copyright or proprietary notices

8. Warranties & disclaimers

The Service is provided "as is" and "as available." We make no guarantees that the Service will be uninterrupted, error-free, or meet your specific requirements.

We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we work hard to keep your data safe, you are responsible for maintaining your own backups of important projects.

9. Limitation of liability

To the maximum extent permitted by law, NEK and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill.

Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. We'll notify you and explain why, except in cases of severe violations.

You may terminate your account at any time. Upon termination, your access ends, but we retain certain data as required by law (see our Privacy Policy).

11. Governing law & disputes

These Terms are governed by the laws of the Republic of Armenia. Disputes shall be resolved in the courts of Yerevan, Armenia, unless local consumer law gives you the right to bring a case elsewhere.

We prefer to resolve issues directly. Before any legal action, contact us at legal@nek.studio and give us 30 days to resolve the issue.
